Terms of service

These Terms of Service ("Terms") govern all purchases made through Livacoco (livacoco.com), operated by Livacoco Fouquet ("we", "us", "our"). By placing an order, you agree to these Terms.

2.1 Provider

2.2 Formation of Contract

Products displayed on our website are not a binding offer, but an invitation for you to place an order. When you submit an order, you are making a binding offer to purchase. A contract is formed once we send you an order confirmation by email. We reserve the right to decline any order, for example in cases of stock unavailability or suspected fraud.

2.3 Prices and Payment

All prices are shown in the currency displayed at checkout and are the total amount payable, unless stated otherwise. As we are not VAT-registered, no VAT is added to the displayed price.

Payments are processed securely through our third-party payment and checkout providers, Whop and CrispCheckout. We do not store your full payment card details. Payment is due at the time the order is placed.

2.4 Shipping and Delivery

Estimated delivery times are shown at checkout and are non-binding estimates. Delivery times may vary depending on destination and customs processes. Risk of loss or damage to products passes to you upon delivery, or upon handover to the carrier if you are a business customer.

2.5 Right of Withdrawal

If you are a consumer, you may have a right to withdraw from your purchase. Please see our separate Right of Withdrawal policy, which forms part of these Terms.

2.6 Retention of Title

Goods remain our property until paid for in full.

2.7 Warranty and Defects

We take reasonable care to ensure products match their description. If you receive a defective or incorrect item, please contact us at support@livacoco.com within a reasonable time of discovery so we can offer a repair, replacement, or refund, without prejudice to any mandatory statutory rights you may have as a consumer under the law of your country of residence.

2.8 Limitation of Liability

To the extent permitted by applicable law, our liability for indirect, incidental, or consequential damages is excluded. Nothing in these Terms limits liability that cannot be limited under mandatory consumer protection law applicable to you.

2.9 Intellectual Property

All content on Livacoco (livacoco.com), including text, images, logos, and design, is owned by or licensed to Livacoco Fouquet and may not be copied or reused without our prior written consent.

2.10 Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules. If you are a consumer resident in the European Union or another jurisdiction with mandatory consumer protection laws, this choice of law does not deprive you of the protections afforded by the mandatory laws of your country of habitual residence.

2.11 Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. We may update these Terms from time to time; the version published on our website at the time of your order applies.
